The present conditions are valid exclusively between the Company ASC s.r.l., with registered office in C.so XXVI Aprile 123 – 20004 Arluno (MI), VAT number 09230280969, hereinafter referred to as “Revolution Concept Store” and any person making purchases online on the website www.revolutionconceptstore.com hereinafter referred to as “CLIENT” . These conditions may be subject to changes and the date of publication of the same on the site is equivalent to the date of entry into force. These conditions regulate purchases made on the www.revolutionconceptstore.com site, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, amended by Legislative Decree n. 21/2014 and by Legislative Decree 70/2003 concerning electronic commerce.
To be able to access on the www.revolutionconceptstore.com online sales services it is mandatory:
– to be 18 years old
– to have an active e-mail address
– to have all legal qualifications that allow you to draw up a contract
– to have a valid credit card for payments accepted or a verified PayPal account or bank account
ARTICLE 1 – Object of the contract
With these general terms and conditions of sale, Revolution Concept Store sells and the CUSTOMER remotely purchases the tangible movable property indicated and offered for sale on the website www.revolutionconceptstore.com. The contract is concluded exclusively through the Internet, through the CUSTOMER access to the address www.revolutionconceptstore.com and the realization of a purchase order according to the procedure provided by the site itself. The contract between www.revolutionconceptstore.com and the CUSTOMER must be considered concluded with the acceptance, even if only partial, of the order. This acceptance is considered tacit, unless otherwise communicated to the CUSTOMER by any means. Before proceeding to confirm the order, the CUSTOMER undertakes to examine these general conditions of sale, in particular the pre-contractual information provided by Revolution Concept Store and to accept them by affixing a flag in the box indicated during the phase of conclusion of the order itself.
ARTICLE 2 – Pre-contractual information for the consumer
The CUSTOMER before the conclusion of the purchase contract examines the characteristics of the goods that are illustrated in the individual product data sheets at the time of choosing the item. Before the conclusion of the purchase contract and before the validation of the order with “payment obligation”, the CUSTOMER is informed regarding: total price in euro of the selected goods, details on shipping costs or any additional costs, payment methods allowed and estimated delivery times. The CUSTOMER may at any time and in any case before the conclusion of the contract take awareness of information relating to the Revolution Concept Store such as, for example, the geographical address, telephone number, and e-mail address (art. 49 of Legislative Decree 206/2005).
ARTICLE 3 – Conclusion and effectiveness of the contract
The sales contract is considered concluded with the sending by Revolution Concept Store to the CUSTOMER of order confirmation e-mail to the e-mail address communicated by the CUSTOMER. This confirmation message will contain date and time of execution of the order and a “customer order number” to be used for any future communication with the store. In addition, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent, will be reported. The CUSTOMER undertakes to verify the correctness of the personal data contained therein and to promptly communicate to Revolution Concept Store any corrections according to the methods described in this document. Once the online purchase procedure has been completed, the customer will print or save a copy of the general sales conditions in compliance with the provisions of the art. 3 and 4 of Legislative Decree 185/1999 on distance selling. For every order placed on the website www.revolutionconceptstore.com, Revolution Concept Store issues an invoice for the goods shipped. The proforma invoice is available and printable, following the execution of the order, in the “My orders” section in the “My account” space reserved for the CUSTOMER on the website www.revolutionconceptstore.com. The proforma invoice will contain the information provided by the CUSTOMER during the purchase process. After issuing the proforma invoice, it will not be possible to make any changes to the order and to the data indicated therein. For the receipt of the electronic invoice, for orders placed from Italy, it is the CUSTOMER’s responsibility to communicate to the e-mail address firstname.lastname@example.org their order number, certified email address and recipient code in order to allow to Revolution Concept Store to correctly carry out the electronic invoicing procedure itself.
ARTICLE 4 – Articles and images online
Revolution Concept Store undertakes to describe and present the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the site and the actual product due to a particular configuration of the computer used by the CUSTOMER or to a malfunction thereof may emerge. For example, the colours of the products displayed on the site may differ slightly from the original ones and in this case www.revolutionconceptstore.com disclaims any liability. Furthermore, the photographs of the products presented on www.revolutionconceptstore.com do not constitute a contractual element, as they are only representative. All images on the www.revolutionconceptstore.com site are the property of ASC S.R.L. and therefore any use not authorized by written consent of ASC S.R.L. itself will be prosecuted according to law.
ARTICLE 5 – Product availability
The availability of the product refers to actual availability at the time the CUSTOMER places the order. This availability must however be considered purely indicative because, due to the simultaneous presence on the site of several users, the products could be sold to other CUSTOMERS before the order is confirmed. Even after sending the e-mail confirming the order sent by Revolution Concept Store, very rare cases of partial or total unavailability of the goods may occur. In this case, the order will be automatically adjusted with the elimination of the unavailable product and the CUSTOMER will be immediately informed by e-mail and the amount spent will be credited back. Even if the order is not accepted, the Revolution Concept Store guarantees a similar procedure.
ARTICLE 6 – Payment methods
Any payment by the CUSTOMER on the site www.revolutionconceptstore.com can only be made using the indicated credit cards, by bank transfer or by PayPal payment method. It is also possible to use cash on delivery in the Italian territory (payment in cash directly to the courier). In case of payment by credit card, the amount will be handled on the next business day at the time of order execution. In the event that bank transfer makes the payment, the order will be processed only when the amount is credited and will be visible on the current account indicated. The communications relating to the payment and the data communicated by the CUSTOMER at the time this is carried out take place on special protected lines.
ARTICLE 7 – Prices
All sales prices of the products indicated on the website www.revolutionconceptstore.com are expressed in Euro. The shipping costs are not included in the purchase price, but are indicated and calculated at the time the order is concluded based on the State from which it is made and the method of payment chosen. The CUSTOMER accepts the right of Revolution Concept Store to change its prices at any time, however the goods will be invoiced based on the prices indicated on the site at the time of completion of the order and indicated in the confirmation e-mail sent by Revolution Concept Store to the client. In case of computer error, manual, technical, or any other nature that could lead to a substantial change, not foreseen by Revolution Concept Store, of the sale price to the public, which makes it exorbitant or clearly derisory, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be credited by bank transfer. Any customs duties, are not included in the shipping cost, but are always charged to the buyer.
ARTICLE 8 – Legal guarantee of conformity
In case the orders are not comply with the order received or even defective, the CUSTOMER has the right to restore, without additional costs, by repairing or replacing it. The CUSTOMER can exercise this right if the defect occurs at the delivery of the good and communicates it to Revolution Concept Store no later than three days after delivery by sending an e-mail to revolution.store.monza@gmail .com. He will have to specify the order number, the problem encountered and attach photographic material testifying the whole. Revolution Concept Store, in the event of a defective or non-compliant product, will arrange at its own expense to organize the collection of the product in accordance with the availability given by the CUSTOMER.
ARTICLE 9 – Orders fulfilment
Orders are generally processed the same day if placed before 12.30 or the following working day if the order was received after this time. If orders are placed during the weekend (from Friday afternoon to Sunday), they will be processed immediately the following Monday. In case of holidays or special events, orders could be processed with a longer time frame (2-3 working days). If the payment method chosen is bank transfer, orders will be processed only when the amount is credited and will be visible on the current account indicated.
ARTICLE 10 – Delivery methods
Revolution Concept Store carries out shipments in Italy and all over the world by express courier GLS, DHL or EMS. The products will be delivered to the address indicated by the CUSTOMER at the time of the order, within the time scheduled by the courier, except in cases of force majeure not attributable to Revolution Concept Store. When the order is shipped, the CUSTOMER will receive an e-mail indicating the shipping number and the link that will allow online traceability. In case of non-receipt of this e-mail, the CUSTOMER can contact our customer service by sending an e-mail to email@example.com. Upon arrival of the goods, the CUSTOMER is asked to check the integrity of the package before signing the courier as proof of delivery of the shipment. If the packaging appears to have been tampered with, the CUSTOMER has the right to refuse the goods by having the courier write down the “tampered-damaged neck” or pick up the goods by having the courier write “with reservation”.
ARTICLE 11 – Responsibility
Revolution Concept Store assumes no responsibility in the event that it fails to execute the order within the time stipulated in the contract due to disruptions caused by force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the Internet network. Revolution Concept Store is also not responsible for delays in shipments caused by weather conditions, customs checks, holidays, particular periods of the year or other circumstances beyond our control. Furthermore, any right of the CUSTOMER damage compensation or indemnity, as well as any contractual or extra contractual liability, is excluded for direct or indirect damages to persons and/or things caused by the non-acceptance, even partial, of an order.
ARTICLE 12 – Access to the site
The CUSTOMER has the right to access at any time to the website www.revolutionconceptstore.com for the consultation and making of purchases. No other use, in particular commercial, of the site or its content is permitted. The integrity of the elements of this site, whether sound or visual, and the related technology used remain the property of Revolution Concept Store and are protected by intellectual property rights. Any unauthorized use by written consent of ASC s.r.l. will be punishable by law.
ARTICLE 13 – Integrity
These “General Terms and Conditions of Sale” consist of all the clauses that compose them. If one or more provisions of these “General Conditions of Sale” is considered invalid or declared as such pursuant to the law, regulation or following a decision by a Court having jurisdiction, the other provisions will continue to have full force and effectiveness.
ARTICLE 14 – Applicable law and competent court
Users who access this website www.revolutionconceptstore.com declare that they accept all questions relating to their use are governed by the legislation in force in the Italian State. ASC s.r.l. does not guarantee in any way that the content of the site complies with the regulations in force in other states. Access to the site from places where the contents are considered illegal is prohibited. Users who decide to access the site from these States are fully aware of the legal consequences and the sanctions they risk incurring and will be solely responsible in compliance with local laws. In the event of a disservice or dispute between ASC s.r.l. and CUSTOMER, arising as a result of the interpretation and execution of these “General Terms and Conditions of Sale”, we guarantee our participation in a friendly settlement attempt pursuant to Legislative Decree 28/2010. Otherwise, the Court of Milan and the Court of the CUSTOMER’s place of residence or domicile will be exclusively responsible if located within the Italian State.
